Namhae: Spacetime Diary Terms of Service

Article 1 (Purpose)

These Terms set out the conditions and procedures for using the Namhae: Spacetime Diary app and related services (the "Service") provided by Romantic Rider (the "Operator"), and the rights, obligations, and responsibilities of users and the Operator.

Article 2 (Definitions)

  1. "Service" means all features provided by the Namhae: Spacetime Diary app running on your device — photo capture with time / location overlay compositing, the map diary, gallery photo import, Namhae-gun tourism information (attractions, festivals, folk tales, and more), commemorative stamps for visiting Namhae landmarks, links to external tourism services, and the like. The specific composition and names of features may be added to or changed through updates.
  2. "User" means anyone who uses the Service under these Terms. The Service is provided without sign-up or accounts.
  3. "User Content" means all photos, notes, and records a user creates and stores while using the Service.

Article 3 (Posting and amending the Terms)

  1. The Operator posts these Terms in the app and on this page.
  2. The Operator may amend these Terms within the bounds of applicable law. Amendments are announced in the app or on this page at least 7 days before taking effect (30 days for changes unfavorable to users or otherwise material).
  3. Continuing to use the Service after an amendment takes effect constitutes acceptance. If you do not accept, you may stop using the Service and uninstall the app.

Article 4 (Content of the Service)

  1. The Service is free and requires no sign-up. Your photos, location, notes, and other data are stored only on your device; the Operator does not collect User Content onto any server.
  2. Map display and address conversion are provided through the Naver Maps API; tourism information on Namhae attractions, festivals, and the like is provided through public and regional data such as the Korea Tourism Organization's TourAPI. Using these features sends the necessary coordinates directly from your device to each API. The Operator may change the data sources and the manner of delivery (direct API calls, delivery via an Operator-managed server, and so on) to improve service quality, and may do so without separate notice as long as the change is not unfavorable to users. Details are governed by the Privacy Policy.
  3. The Service provides links to the web pages of external services — Nangman Namhae (the Namhae-gun tourism platform), the Namhae Cultural Center, and others — for details and reservations at attractions, restaurants, and lodgings. Any transaction made on an external service (such as a reservation or purchase) is between you and that service (or the listed business); the Operator is not a party to the transaction and does not guarantee the external service's content or performance. Use of an external service is governed by its own terms and privacy policy.
  4. The Service currently displays no advertising. The Operator may introduce advertising or paid features to cover operating costs; in that case, the change will be announced in the app and reflected in the relevant documents (these Terms and the Privacy Policy) before it takes effect.
  5. The Operator may introduce account and login features (including social login) and additional features based on them. In that case, the introduction will be announced in the app and reflected in the relevant documents beforehand, and separate consent will be obtained for the processing of account-related personal data.
  6. The Operator may introduce features that let users choose to share or post their User Content — photos and the like — to other users or the public (for example, regional or festival photo albums, or group sharing). Before launching such a feature, the Operator will announce the scope of shareable content, the visibility settings, and the license needed to provide the feature, through in-app notice and revision of the relevant documents, and will obtain separate consent when a user first uses the feature. Content belonging to users who do not use sharing remains stored only on their devices under Article 6; this paragraph changes nothing about that.

Article 5 (Changes and interruption of the Service)

  1. The Operator may temporarily suspend all or part of the Service for updates, maintenance, and similar work.
  2. Features may be limited by causes beyond the Operator's control — natural disasters, telecom carrier outages, or failures and policy changes of external APIs and services (maps, tourism information, Nangman Namhae, and the like).
  3. The Operator may change or terminate all or part of the Service for substantial managerial or technical reasons, with prior notice in the manner of Article 3. Even if the Service ends, your User Content remains on your device.

Article 6 (Rights in User Content and data management)

  1. All rights in User Content, including copyright, belong to you. The Operator neither accesses nor collects User Content and claims no license to it.
  2. Because User Content is stored only on your device, it can be lost through device loss, failure, or reset, or by uninstalling the app. Backing up your data is your responsibility, and the Operator is not liable for such loss. Commemorative stamp records are likewise stored only on your device.
  3. Sharing photos outside the app (to other apps, social media, and so on) and its consequences are your responsibility.

Article 7 (Prohibited conduct)

When using the Service you must not:

  1. Attempt to derive source code or algorithms by decompiling, disassembling, or reverse-engineering the app (except where expressly permitted by law)
  2. Disrupt the Service through abnormal or automated access to the app or to the external APIs and services it uses
  3. Copy, distribute, or sell all or part of the Service, or create derivative works, without authorization
  4. Use the Service for photography or records that infringe others' rights, including privacy and likeness
  5. Forge or alter the time / location overlay, or use overlaid photos dressed up as fact to deceive others
  6. Obtain commemorative stamps or other visit-based elements by improper means such as location spoofing
  7. Otherwise violate applicable law

Article 8 (Location-based services)

1. Content of the service

The Operator uses your device's location data to provide the following free of charge: recording and overlaying the coordinates at photo capture, showing photos on the map, converting coordinates to addresses, nearby tourism information, and confirming visits to Namhae landmarks (commemorative stamps).

2. Handling of personal location data

  1. Location data is processed and stored on your device; the Operator does not collect or retain it on any server. Visit confirmation (commemorative stamps) is likewise judged entirely on the device.
  2. For address conversion and tourism information, coordinates are sent directly from your device to external APIs (NAVER Cloud, Korea Tourism Organization) and used transiently to generate the response.
  3. Location records stored on the device are destroyed immediately when you delete the photo or record, or uninstall the app.

3. Provision to third parties

The Operator does not provide personal location data to third parties. If a service requiring such provision is ever introduced, users will be notified in advance and consent obtained.

4. Your rights

  1. You can withdraw the location permission in device settings at any time; only location-dependent features are affected.
  2. You can delete geotagged photos and records in the app at any time.

5. Protection of children aged 8 or under, etc.

Where the guardian of a child aged 8 or under, an adult ward, or a person with a mental disability consents to the use of that person's personal location data to protect their life or physical safety, the consent is deemed to be the person's own under Article 26 of the Act on the Protection and Use of Location Information.

6. Damages

If you suffer damage because the Operator violated the Act on the Protection and Use of Location Information, you may claim damages from the Operator. The Operator cannot escape liability unless it proves the absence of intent or negligence.

7. Provider information and location data manager

Article 9 (Intellectual property)

  1. Copyright and other intellectual property in the Service (the app, logo, design, software, and so on) belong to the Operator or its rightful owners.
  2. Map data comes from NAVER; the illustrated background of the Namhae guide map is a derivative of OpenStreetMap data under ODbL 1.0.
  3. Tourism information on attractions, festivals, and the like comes from the Korea Tourism Organization's TourAPI and Namhae-gun-related institutions, subject to each provider's conditions. Folk tales, webtoons, and other content of the Namhae Cultural Center belong to that institution; the Service does not reproduce them and only links to their web pages.
  4. You are granted only a revocable, non-transferable right to use the Service for personal, non-commercial purposes.

Article 10 (Disclaimer of warranties)

  1. The Service is provided "as is"; the Operator does not warrant uninterrupted or error-free operation.
  2. The time, coordinates, address, and other overlay information stamped on photos may differ from reality due to device GPS accuracy and the limits of external APIs (reverse geocoding and the like). The Operator does not warrant the accuracy or completeness of overlay information; using it for legal evidence or other consequential purposes is at your own judgment and risk.
  3. The accuracy and currency of information based on external APIs and institutions follows each provider's data. Festival dates, opening hours, and the like may differ from reality — checking before visiting is recommended.
  4. Commemorative stamps and other visit-based elements may misjudge within the limits of device GPS accuracy.

Article 11 (Limitation of liability)

  1. For this free Service, the Operator is not liable for damage you incur unless caused by the Operator's intent or gross negligence.
  2. The Operator is not liable for damage from causes beyond its control — your device environment, network failures, or matters attributable to external API and service providers.
  3. The limitation on data-loss liability in Article 6(2) applies under this Article as well.

Article 12 (Dispute resolution)

  1. If a dispute arises between the Operator and a user over the Service, both sides will consult in good faith toward an amicable resolution.
  2. Failing that, suit may be brought in the court of jurisdiction under the Civil Procedure Act of the Republic of Korea; the governing law is the law of the Republic of Korea.
  3. For disputes over location data, you may apply to the Korea Communications Commission for a ruling under Article 28 of the Act on the Protection and Use of Location Information, or to the Personal Information Dispute Mediation Committee for mediation.

Article 13 (Matters not provided for)

Matters not provided for in these Terms follow the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on the Regulation of Terms and Conditions, other applicable laws, and commercial practice.
