Spacetime Diary Terms of Service
Article 1 (Purpose)
These terms govern the conditions and procedures for using the Spacetime Diary app and related services (the "Service") provided by Romantic Rider (the "Operator"), and the rights, obligations, and responsibilities of users and the Operator.
Article 2 (Definitions)
- "Service" means all features of the Spacetime Diary app running on your device — photo capture with time/location overlays, the map diary, photo library import, nearby attractions, and related features.
- "User" means anyone who uses the Service under these terms. The Service requires no account or sign-up.
- "User Content" means all photos, notes, and records you create and store while using the Service.
Article 3 (Posting and changes to these terms)
- These terms are posted in the app and on this page.
- The Operator may revise these terms within the bounds of applicable law. Revisions are announced in the app or on this page at least 7 days before taking effect (30 days for changes unfavorable to users or otherwise material).
- Continuing to use the Service after a revision takes effect constitutes acceptance. If you do not agree, you may stop using the Service and delete the app.
Article 4 (The Service)
- The Service is free and requires no account. Your photos, locations, and notes are stored only on your device; the Operator does not collect User Content to any server.
- Map display and address lookup use the Naver Maps API; nearby attraction data comes from the Korea Tourism Organization TourAPI. Coordinates needed for these features are sent directly from your device to each API. Details are governed by the Privacy Policy.
- To cover operating costs, a banner ad is displayed at the bottom of the diary list screen in Spacetime Diary. Ads are served through Google AdMob, and the data processed in serving them is governed by sections 1-2 and 3 of the Privacy Policy. The Operator does not individually select the content or advertisers shown, and is not a party to any transaction for the goods or services advertised. If an ad causes you harm, please report it to romanticrider.app@gmail.com and the Operator will act to stop that ad from being shown.
- The Operator may introduce paid features, or change the form or extent of advertising, in the future. Any such change will be announced in advance in the app, with corresponding revisions to these terms and the Privacy Policy.
- The Operator may in the future introduce features that allow users, at their own choice, to share or post photos and other User Content with other users or with the public (e.g., regional or festival photo albums, group sharing). Before introducing any such feature, the Operator will announce the scope of content to be shared, its audience, and the license required to operate the feature through in-app notice and revisions to this Agreement and the Privacy Policy, and will obtain the user's separate consent at the time the user first uses the feature. Content of users who do not use sharing features remains stored only on their device pursuant to Article 6, and this paragraph does not alter that in any way.
Article 5 (Changes and interruption of the Service)
- The Operator may temporarily suspend all or part of the Service for updates and maintenance.
- Features may be limited by causes beyond the Operator's control, such as natural disasters, telecom outages, or failures and policy changes of external API providers (maps, tourism data).
- The Operator may change or discontinue all or part of the Service for significant business or technical reasons, with prior notice as described in Article 3. Even if the Service ends, your User Content remains on your device.
Article 6 (Your content and data responsibility)
- All rights, including copyright, to User Content belong solely to you. The Operator does not access or collect User Content and claims no license to it.
- Because User Content is stored only on your device, it can be lost through device loss, failure, reset, or app deletion. Backing up your data is your responsibility, and the Operator is not liable for such loss.
- Sharing your photos externally (other apps, social media, etc.) and its consequences are your responsibility.
Article 7 (Prohibited conduct)
When using the Service, you must not:
- Decompile, disassemble, or reverse engineer the app to derive its source code or algorithms, except as expressly permitted by law;
- Interfere with the Service through abnormal or automated access to the app or the external APIs it uses;
- Copy, distribute, sell, or create derivative works of the Service without authorization;
- Use the Service for recordings that violate others' rights, including privacy and likeness rights;
- Forge or alter the time/location overlay, or use overlaid photos to deceive others by misrepresenting facts;
- Otherwise violate applicable laws.
Article 8 (Location-based services)
① Scope
Using your device's location, the Operator provides free of charge: recording and overlaying capture coordinates, showing photos on the map, converting coordinates to addresses, and finding attractions near your current location.
② Handling of personal location information
- Location data is processed and stored within your device; the Operator does not collect or retain it on any server.
- For address lookup and nearby attractions, coordinates are sent directly from your device to external APIs (NAVER Cloud, Korea Tourism Organization) and used momentarily to generate the response.
- Location records stored on your device are destroyed immediately when you delete the related photos/records or uninstall the app.
③ Third-party provision
The Operator does not provide personal location information to third parties. If a future feature requires it, users will be notified and asked for consent in advance.
④ Your rights
- You may revoke location permission anytime in device settings; only location features are affected.
- You may delete location-tagged photos and records in the app at any time.
⑤ Protection of children aged 8 or under
Where a legal guardian of a child aged 8 or under, an adult ward, or a person with a mental disability consents to the use of that person's location information to protect their life or safety, such consent is deemed the person's own consent under Article 26 of the Act on the Protection and Use of Location Information.
⑥ Damages
If you suffer damage because the Operator violated the Act on the Protection and Use of Location Information, you may claim damages from the Operator. The Operator cannot avoid liability unless it proves the absence of intent or negligence.
⑦ Location information manager
Location information manager: Representative, Romantic Rider (contact: romanticrider.app@gmail.com)
Article 9 (Intellectual property)
- Copyright and intellectual property in the Service (app, logo, design, software) belong to the Operator or its rightful licensors.
- Map data is provided by NAVER and tourism data by the Korea Tourism Organization TourAPI, subject to each provider's terms.
- You are granted only a revocable, non-transferable right to use the Service for personal, non-commercial purposes.
Article 10 (Disclaimer of warranties)
- The Service is provided "as is"; the Operator does not warrant uninterrupted or error-free operation.
- Overlay information (time, coordinates, address) may differ from reality due to GPS accuracy and the limits of external APIs such as reverse geocoding. The Operator does not warrant its accuracy or completeness; relying on it for legal evidence or other critical purposes is at your own judgment and risk.
- The accuracy and freshness of externally sourced information (e.g., nearby attractions) depend on the providing institution's data.
Article 11 (Limitation of liability)
- For this free Service, the Operator is not liable for damages you incur unless caused by the Operator's intent or gross negligence.
- The Operator is not liable for damage caused by factors beyond its control, including your device environment, network failures, or external API providers.
- The data-loss limitation in Article 6(2) also applies under this article.
Article 12 (Dispute resolution)
- The Operator and users shall consult in good faith to resolve disputes arising from the Service.
- Unresolved disputes may be brought before the court of jurisdiction under the Civil Procedure Act of Korea; the governing law is the law of the Republic of Korea.
- Location-information disputes may be referred to the Korea Communications Commission for adjudication under Article 28 of the Act on the Protection and Use of Location Information, or to the Personal Information Dispute Mediation Committee.
Article 13 (Miscellaneous)
Matters not specified in these terms follow applicable laws — including the Act on the Protection and Use of Location Information, the Personal Information Protection Act, the Network Act, and the Act on the Regulation of Terms and Conditions — and customary practice.
